Development plans

Development plans are part of the urban land-use plans and regulate the structural and other utilisation of the respective properties. The development plans are to be developed from the land use plan, i.e. the objectives of the development plan should not contradict the land use plan. In contrast to the land use plan, the development plan only covers parts of the city. However, both must be approved by the city council.

The municipality must draw up a development plan if urban development and organisation is required. A development plan can therefore also be required in an already built-up area and does not necessarily have to be aimed at the development of a previously undeveloped area.

Types of development plans

The following map shows the development plans of the district town of Radebeul. A distinction is made between municipal and project-related development plans.

The municipal development plan is drawn up by the municipality itself as soon as and insofar as it is necessary for urban development and organisation. The project-related development plan, on the other hand, requires a concrete project as a basis as well as a project sponsor to submit an application and a willingness to contractually take on the development and construction of the project within a certain period of time.

Procedure for a development plan

The standard procedure for drawing up a development plan usually begins with the city council's decision to draw up the plan. This resolution is published in the official gazette and serves to inform the public. Following the preparation of a first draft of the development plan, the so-called preliminary draft, the authorities and public agencies as well as the public (citizens) are involved at an early stage. The public is informed about the general objectives and purposes of the planning and has the opportunity to submit comments during the public display period. Once the comments received within the deadline have been analysed, a draft of the development plan is drawn up. This draft, which has been agreed with the City Council's Urban Development Committee, is made available to the public for inspection for a period of one month (formal participation). During the publication period, anyone can again submit a statement. The comments of the relevant authorities and public agencies on the draft development plan are also obtained. The comments received and the issues that are of importance for consideration are identified, assessed and decided on by the urban development committee. The city council then adopts the development plan as a statute. This so-called statute resolution is publicised locally and comes into force upon publication.

Change ban on development plans

During the process of a development plan, the admissibility of projects under planning law is governed by the previously applicable planning regulations. In order to safeguard the planning or objectives of the development plan currently being drawn up, the municipality can issue a change ban for the planning area and freeze the legal planning status. The change ban expires after two years. However, the municipality can extend the period by a further year if necessary.
