Information on the implementation of neighbouring property obligations

The Legal and Regulatory Office asks all property owners to ensure that the footpaths or shared footpaths and cycle paths adjacent to their property, as well as the cutting channels belonging to the carriageway and adjacent to the footpaths (for exceptions, see bylaws), are cleaned regularly.
In particular, the areas must be swept as required,
- swept at least once a week,
- clear the areas of grass, weeds and leaves and keep them in a well-kept condition,
- remove rubbish and mud
The dirt, rubbish, waste etc. that accumulates during cleaning must be disposed of in separate containers. Care must be taken to use environmentally friendly products.
In the absence of a pavement, the parts serving pedestrian traffic at the edge of the public roads must be cleaned to a width of 1.5 m, measured from the property boundary, or if there are no pavements in pedestrian zones or traffic-calmed areas, a strip 1.5 m wide along the property boundary.
This also includes pruning branches of trees or bushes that protrude into the pavement, as these often severely restrict the use of the pavement.
As a rule of thumb, it should be possible for an adult with an umbrella to use the pavement without hindrance, which is why plants should be trimmed back to 2.50 m above the top edge of the pavement and 4.50 m above the top edge of the carriageway.
It should also be noted that, particularly in narrow streets, the passage of public utility vehicles (e.g. waste disposal) must be ensured and that no traffic signs or other public signage (e.g. street name signs) are obscured by shrubs or hanging branches.

A copy of the above-mentioned statutes is available from the Legal and Public Order Office, Pestalozzistraße 4, 01445 Radebeul.
