Preservation statutes for the "Niederlößnitz and Oberlößnitz villa areas" of the district town of Radebeul

The conservation statutes for the Niederlößnitz and Oberlößnitz villa areas aim to preserve the urban character of these areas. Demolition, alteration, change of use and construction of buildings in the area covered by these statutes must always be authorised. Previously, demolitions only had to be notified and certain smaller buildings could be erected without authorisation.

At its meeting on 27 November 2019, the Radebeul City Council decided to draw up these conservation statutes. Many citizens share the view that the development jeopardises what characterises the villa areas of Lößnitz. This led to the political decision to draw up a conservation statute in accordance with section 172(1)(1) of the German Building Code.

The architectural firm Dr Braun & Barth from Dresden was commissioned to analyse the urban character of Niederlößnitz and Oberlößnitz and then to describe in detail what this character consists of. The townscape of Niederlößnitz and Oberlößnitz is characterised by winegrowers' houses, summer residences and villas, dry stone walls, representative enclosures and landscaped front gardens.

An overview plan shows the area of application of the conservation statutes for each property. It is part of the statutes and can be downloaded from this page, as can the text of the statutes themselves and the detailed brochure with the results of the survey. This brochure is also available as a print version from the Urban Development Office and can be handed out on request.

In future, buildings that are not listed buildings can also be protected from demolition with reference to the preservation statutes. The prerequisite is that they contribute to the typical townscape. If a new replacement building is built, it must fit in with the character of the area.

However, buildings and properties that do not correspond to this townscape are not protected by the conservation statutes. Whether this is the case must be checked for each building project, irrespective of the planning permission. There are therefore no longer any projects that do not require planning permission. The urban development office is responsible for authorisation in accordance with Section 172 of the Building Code.

The statutes were adopted by the city council on 18 January 2023 and published in the 03/2023 issue of the official gazette.
